Patent Filing Requirements
  • Specification, claims, formal drawings, and abstract.
  • Deed of assignment document if the applicant is not the inventor.

Notes
For the registration of a granted South African patent, the following are required:
1- Power of attorney simply signed (no set deadline).
2- Certified copy of the South African patent (required on the day of filing).

The law has not been amended yet to accept application based on convention or PCT applications. Although ARIPO applications designating Swaziland are filed and accepted, there is no guarantee that an ARIPO patent will be enforceable in Swaziland.

Annuity Requirements
  • No documents are required.

Patent Search
  • No documents are required.

Patent Assignment
  • Power of attorney signed by the assignee.
  • Deed of assignment document signed by the assignor and assignee.

Notes
  • Late filing of documents: not allowed.

Patent Merger
  • Power of attorney simply signed.
  • Merger agreement document signed by both parties.

Notes
  • Late filing of documents: not allowed.

Patent Recordal of Change
  • Power of attorney reflecting the new name or address simply signed.
  • Certified copy of the certificate of incorporation or an extract from the commercial register reflecting the change.

Notes
  • Late filing of documents: not allowed.

Patent License
  • Power of attorney signed by the licensee.
  • License agreement document signed by both parties.
