Trademarks - Filing Requirements


Filing Requirements
  • Power of attorney notarised.
  • Prints of the mark.
  • Name and address of the applicant.
  • Certified copy of the priority document if claimed.

Notes
  • Late filing of documents: 2 months from filing date without penalty.

Registration with Customs Duty
  • Full information about the owner.
  • Extract from the commercial register.
  • Description of the IP object.
  • Names and addresses of the companies producing the said product (IP object), licenses provided to and authorisations of such companies.
  • Place of production of the original goods.
  • Documents certifying ownership for the IP object, i.e. certificate of registration, extract from International Bureau of WIPO, license agreement, etc.
  • Description of the original goods, samples, photos, or any other information which can help to identify the legitimate products.
  • Any information which can help to identify the counterfeiting goods, i.e. name and address of the importer of suspected goods, place of production of counterfeiting goods, etc.
  • Agreement between the owner and the customs on covering of the customs' expenses related to the suspension of the imported goods (if the owner does not wish to initiate court proceedings with respect to the declarant). This Agreement is not necessarily in practice -since the execution procedure is not adopted yet- and applicants should submit a Guarantee Letter only. This Guarantee letter is addressed to six Customs Posts of Kyrgyzstan.
  • Evidence of payment of the Official fees.

Notes
According to the legislation term of consideration of the application is one month. However, in practice such application considered by Customs officers within 3 months (note: Customs just started to register trademarks, so they don't have practice yet).

Renewal Requirements
  • Power of attorney notarised.
  • The original registration certificate of the trademark.

Search Requirements
  • No documents are required.

Assignment Requirements
  • Power of attorney simply signed by the assignor and the assignee sealed by the corporate seal. Each document should be also dated and must show the company's name and address as well as the name and corporate position of the signing person. Notarisation is not required.
  • Triplicate of original assignment deed signed by both the assignor and the assignee. Each document should also indicate the complete address of the parties involved in the assignment, class coverage for the assignment, the place and date of signing, and the names and corporate positions of the signing persons. Notarisation is not required

  • Notarised document confirming the changes.
  • Original registration certificate of the trademark.
