A design patent will not be granted in respect of any of the following:

• shape of an article, which is solely dictated by its function;
• artistic work;
• layout of an integrated circuit and electronic circuits;
• article contrary to public order or morality.

An object of an industrial design in Taiwan may be a shape, pattern, color, or combination thereof of an article through visual appeal, Industrial designs and Utility models are covered under the Patents Act.
