The decree was made known to IP agents on 1 October 2017, and will become effective on 15 October 2017 affecting applications pending publication, as follows:

 
It is worth mentioning that renewals with respect to trademarks filed or renewed before April 2007 will be published twice, the first time after acceptance and the second time after issuing the registration or renewal certificate. While renewals with respect to trademarks filed or renewed after April 2007, there will be only one publication after acceptance.

Official Fees
A decision has now been issued regarding the new tariffs to be followed by the Office, which is now approved and will be considered as of today’s date for all new applications.

Changes in Practice
New amendment has been introduced to the application practice where applicants are requested to submit and obligatory advanced search application prior to the application for registration, and based on the search report; the applicant can submit the trademark application.

Needless to remind that the required documents for filing a new trademark application are:

1. Power of attorney legalised by the Iraqi Consulate;
2. Copy of the foreign registration certificate or application as filed with Arabic translation, legalised by the Iraqi Consulate, and
3. Photocopy of the commercial register or the extract with Arabic and English translation.

The official filing fees for new applications as well as the official publication fees for the same remains unchanged, while the increase affects the registration fees only. Also, the official publication fees for the renewal applications stay still, as the new tariffs affect the official renewal fees only. The official fees for recordals were not affected.

It is not clear whether the new fees will have a retroactive effect on pending applications or not. However, we shall prepare and submit a petition to the Registrar requesting that pending marks were filed prior to the increase decision and shall, therefore, not be subject to the increase. But, this does not guarantee the outcomes.

Finally, our professional fees shall remain unchanged.

The Decree was published in the Official Gazette of Kuwait (Al-Kuwait Al-Youm) issue No.1268 dated 27 December 2015 effective 28 December 2015, and will affect all trademark applications filed after said date as well as retroactively for pending applications as regards to their publication and registration.

As we mentioned in our newsletter article in October 2015 regarding this matter, it is possible to issue registration certificates for expired applications after paying the normal renewal fee as well as paying the registration fee simultaneously.

To submit renewal applications or obtaining registration certificates, applicants are required to provide specimen of the mark, filing number, filing date, applicant details, class, and list of goods. No other documents are needed.
