The new framework came into effect on 14 November 2025.

 

Key Highlights:

  • 50% Fee Reduction for Small and Medium Enterprises (SMEs) registered under the National SME Programme.
  • Full Exemption from trademark service fees for People of Determination.
  • New Services Introduced, including:
    • One-Day Trademark Examination
    • Temporary Protection for trademarks used at recognised exhibitions and events
    • Conversion of National Applications into International Registrations under the Madrid Protocol

The updated resolution also restructures the appeal and opposition framework, introducing official fees for appeals against refusals, amendments, and opposition decisions. It further expands procedures for dispute resolution, with new charges for cancellation actions and appeals before the Grievance Committee.

On the enforcement front, the Ministry has introduced new procedures for assessing potential trademark infringement and has reaffirmed that multi-class applications remain subject to per-class fees, pending the launch of the updated e-services platform.

Additional updates include fee adjustments for post-registration actions, particularly for renewals of certification and collective marks within the grace period. A new process now allows rights holders to appeal refusals to amend registered logos, addressing a gap in previous practice.

These reforms reflect the UAE’s continued efforts to modernise its IP infrastructure, promote inclusive access to trademark services, and support innovation across sectors.

KUWAIT: FIVE-YEAR VALIDITY LIMIT INTRODUCED FOR POWERS OF ATTORNEY https://njq-ip.com/newsletters/2025/11/kuwait-five-year-validity-limit-introduced-for-powers-of-attorney/ Sun, 30 Nov 2025 08:12:55 +0000 https://njq-ip.com/?post_type=newsletter&p=11231 KUWAIT CITY – The Kuwait Ministry of Justice has enacted Decree-Law No. 147 of 2025, amending key provisions of the Notarization Law, to regulate the duration and scope of Powers of Attorney (POAs). The decree was officially published in the Official Gazette and is now in force.

Under the new rules, POAs are limited to a maximum validity period of five years, unless a shorter term is specified or another reason terminates the POA earlier. All notarised POAs must now explicitly state their expiration date, although expiry of notarisation does not impact the legal relationship between the parties.

Additionally, POAs issued prior to the effective date of this decree will remain valid for two years from the effective date.

The updated regulation excludes commercial agency contracts, as well as other cases that may be exempted by decision of the Minister of Justice.

QATAR: INDUSTRIAL DESIGN APPLICATIONS NOW ACCEPTED https://njq-ip.com/newsletters/2025/10/qatar-industrial-design-applications-now-accepted/ Sun, 26 Oct 2025 20:51:47 +0000 https://njq-ip.com/?post_type=newsletter&p=11225 DOHA – The Qatari Ministry of Commerce and Industry, through the Intellectual Property Rights Protection Department (the Department), has officially announced the commencement of industrial design application filings. This marks a long-anticipated development in the implementation of Qatar’s Industrial Design Law, which had remained dormant due to the absence of implementing regulations and administrative procedures.

As of October 2025, industrial design applications may now be submitted in person at the Department in the Ministry’s main building. Applicants are required to pay the applicable official fees at the reception desks after filing their application.

The Ministry has clarified that all application forms, required documents, and the adopted classification system are now available on the official website of the Ministry of Commerce and Industry.

The required documents are:

  • Power of attorney, legalised.
  • Copy of the inventor’s ID Card, passport, or commercial register.
  • Copy of the applicant’s ID Card, passport, or commercial register.
  • Copy of the design figures (digital images) if the design is 2-dimensional. If the design is 3D, the copies must cover all views (no more than 25 images).
  • Certified copy of the priority document (if claimed).

This development signals the activation of industrial design protection in Qatar, where previously the only option to protect a design was to publish a cautionary notice containing design details in a daily newspaper.

SUDAN: INTELLECTUAL PROPERTY OFFICE TO RESUME OPERATIONS IN KHARTOUM https://njq-ip.com/newsletters/2025/10/sudan-intellectual-property-office-to-resume-operations-in-khartoum/ Wed, 22 Oct 2025 15:28:20 +0000 https://njq-ip.com/?post_type=newsletter&p=11223 KHARTOUM – The General Registrar of Intellectual Property (IPO) in Sudan has announced the relocation of its physical operations back to Khartoum, following a period of temporary displacement to Port Sudan due to the country’s recent instability.

The Port of Sudan office, while active, operated with limited capacity. For example, while new intellectual property applications were accepted in chronological order to preserve applicants’ priority rights, subsequent procedures—such as examination and publication—were postponed until full operations could be resumed.

With conditions in Khartoum now showing signs of improvement, the IPO has confirmed that it will fully resume its functions at its original headquarters by the beginning of November 2025.

Due to the turbulent situation, and to ensure consistency of its data, the IPO now requests that all renewal and recordal applications be accompanied by a photocopy of the trademark registration certificate, the last renewal certificate, or the last recordal certificate.

YEMEN – ADEN: NEW DECLARATION REQUIREMENT FOR CLASS 5 TRADEMARK APPLICATIONS https://njq-ip.com/newsletters/2025/10/yemen-aden-new-declaration-requirement-for-class-5-trademark-applications/ Wed, 22 Oct 2025 15:26:27 +0000 https://njq-ip.com/?post_type=newsletter&p=11222 ADEN – The General Department for Intellectual Property Protection, under the Ministry of Industry and Trade in Aden, has introduced an additional procedural requirement for trademark applications filed under Class 5 (Pharmaceuticals and Medical Supplies).

Applicants seeking to register trademarks in this class must now submit a formal declaration confirming the following:

  • The trademark is being registered for priority rights protection only, and
  • The mark will not be used within the Yemeni market.

This declaration is subject to an official fee of YR 30,000 and may be drafted by legal officers at the Department.

It is important to note that this declaration is only a formality and does not authorise the commercial use of pharmaceutical or medical goods in Yemen. Actual use of such goods remains strictly dependent upon obtaining a separate licence from the Supreme Authority for Medicines and Medical Supplies.

This new requirement replaces the Department’s previous policy, which had been in effect for several months, whereby applicants were required to provide a license from the Supreme Authority to proceed with trademark applications in Class 5.

These updates come through Cabinet Resolution No. (102) of 2025, issued on 8 October 2025, which will enter into force on 15 November 2025, and a corresponding update to individual fees under the Madrid Protocol, effective 2 November 2025.

Revised Madrid Protocol Fees:
As announced by the World Intellectual Property Organization (WIPO), the individual fee for designating the UAE under the Madrid Protocol has been reduced from CHF 1,630 to CHF 1,420 per class, applicable to international applications, subsequent designations, and renewals filed on or after 2 November 2025.

New Services Introduced by the UAE Ministry of Economy and Tourism:
The updated domestic framework includes:

  • One-day trademark examination (express examination) with an additional fee.
  • Temporary trademark protection for events, exhibitions, and workshops.
  • Conversion of national applications to international applications under the Madrid Protocol
  • New appeal fees based on the nature of the dispute (e.g. appeal against rejection or opposition decisions).
  • 50% fee reduction for SMEs registered under the UAE National SME Programme.
  • Full fee exemption for People of Determination, promoting equal access to trademark services.

LEBANON: SIMPLIFIED RULES FOR TRADEMARK ASSIGNMENTS https://njq-ip.com/newsletters/2025/09/lebanon-simplified-rules-for-trademark-assignments/ Tue, 30 Sep 2025 06:34:21 +0000 https://njq-ip.com/?post_type=newsletter&p=11216 BEIRUT – The Intellectual Property Protection Department at the Ministry of Economy and Trade in Lebanon (TMO) has announced a significant procedural change regarding the assignment of trademarks.

The TMO has reverted to its earlier practice of not requiring the submission of the original trademark registration certificate when recording a transfer of ownership. Previously, the original certificate had to be filed for endorsement purposes, adding an additional step for applicants.

Under the updated procedure, the documentation needed for an assignment is now limited to the following:

  • a Power of Attorney;
  • a Deed of Assignment; and
  • a scanned copy of the registration certificate.

LIBYA: TEMPORARILY SUSPENDS TMO OPERATIONS AMID ADMINISTRATIVE TRANSITION https://njq-ip.com/newsletters/2025/08/libya-temporarily-suspends-tmo-operations-amid-administrative-transition/ Sat, 23 Aug 2025 08:00:22 +0000 https://njq-ip.com/?post_type=newsletter&p=11214 TRIPOLI – The Libyan Council of Ministers has recently issued Decision No. 366 of 2025, transferring the administrative responsibilities of the Trademark Office (TMO) to the Commercial Registration Authority as of early August 2025. The TMO will remain under the umbrella of the Ministry of Economy and Trade.

This shift requires some time, during which the TMO is not accepting new trademark applications. Additionally, trademark transactions with deadlines falling during the suspension period will not be abandoned. Instead, these deadlines will be automatically carried forward and processed once the TMO resumes its operations.
