Previously, after obtaining the initial acceptance from the TMO, applicants could file the trademark application after the payment of the official filing fees. The TMO would then review the formalities of the application (i.e. submission of the PoA) and send a request to pay the official publication fees. Per the new practice, however, the official publication fees must be paid with the official filing fees.

LEBANON: UPDATES AT THE TRADEMARK OFFICE https://njq-ip.com/newsletters/2024/03/lebanon-updates-at-the-trademark-office/ Wed, 27 Mar 2024 09:47:50 +0000 https://njq-ip.com/?post_type=newsletter&p=11128 BEIRUT – Lebanon has recently passed a new Budget Law number 134, introducing new changes in the Trademark Office, effective as of 15 February 2024.

The trademark protection period is now ten (10) years instead of 15. This will only affect trademarks registered or renewed after the effective date.

The official fees have increased as a result of this law for all intellectual property transactions.

LIBYA: POWERS OF ATTORNEY ARE VALID FOR ONE YEAR https://njq-ip.com/newsletters/2024/02/libya-powers-of-attorney-are-valid-for-one-year/ Thu, 15 Feb 2024 07:54:14 +0000 https://njq-ip.com/?post_type=newsletter&p=11124 TRIPOLI – The Ministry of Commerce and Trade issued a circular on 14 February 2024, stipulating new rules regarding the powers of attorney (PoA) and other related matters.

The circular states that the legalised PoA is valid for only one (1) year. Therefore, agents must submit a new legalised PoA annually to maintain the applicant’s trademark registration. The same applies to the commercial register document. Failing to do so will result in the cancellation of the registration.

SUDAN: THE TRADEMARK OFFICE RESUMES ITS OPERATIONS https://njq-ip.com/newsletters/2024/02/sudan-the-trademark-office-resumes-its-operations/ Thu, 15 Feb 2024 07:52:53 +0000 https://njq-ip.com/?post_type=newsletter&p=11123 The Trademark Office in Sudan resumed its operations on 11 February 2024, after it was suspended for almost 10 months. It is now accepting new applications for registration, renewals, and recordals. The TMO will process new applications, put them on hold, and continue processing older pending applications.

Please note that the Trademark Office has relocated from Khartoum to Port Sudan.

LIBYA: UPDATES AT THE TRADEMARK OFFICE https://njq-ip.com/newsletters/2024/01/libya-updates-at-the-trademark-office/ Fri, 26 Jan 2024 08:36:05 +0000 https://njq-ip.com/?post_type=newsletter&p=11118 TRIPOLI – The Minister of Commerce and Trade issued Regulation No. 26 in 2024 regarding the trademark practice in Libya.

The main aspects of the new regulation are as follows:

  • Introduction of provisions to register and protect sound marks
  • Electronic publication of the accepted applications
  • Opposition period shortened from 60 days to 30 days
  • Adoption of the 11th Edition of Nice Classification
  • New increased official fees
  • Trademark protection is restricted to the trademark as applied for, i.e., Applications consisting of a black-and-white trademark will only protect the black-and-white version of the mark and will not extend to other coloured versions of the brand. The applied-for mark must be identical to the mark in use

This Decree was published on 17 January 2024 and will go into effect 30 days from the date of publication.
