Application for Registration
It is now obligatory to lodge a request for examination for trademarks before filing an application. If the examination result is positive, applicants may submit an application for registration accompanied with the examination report where the application will then be accepted and proceed to publication immediately.

If the examination result was negative, applicants can still file an application for registration and then appeal the refusal decision before the court.

Examination
Examination time for a trademark application is six (6) months. The home registration certificate must be submitted for applications designating class 5 with subclass (a) within 6 months of the filing date. Failing to provide said document, the application will be cancelled and applicants will have to file a new application. Iraq follows a multi-class filing system where each class is divided to subclasses; class 5 subclass (a) covers pharmaceutical and veterinary preparations and sanitary preparations for medical purposes.

Recordal Applications
Recordal transactions on pending trademarks are no longer accepted. In order to file an application to record an assignment, change of name, change of address, or merger, the trademark must be registered with a valid registration certificate.

For independent searches, the applicant’s full address should be provided; otherwise, the search request will be denied.

Oman – Patent Substantive Examination Update https://njq-ip.com/newsletters/2016/09/oman-patent-substantive-examination-update/ https://njq-ip.com/newsletters/2016/09/oman-patent-substantive-examination-update/#respond Wed, 28 Sep 2016 06:03:21 +0000 https://njq-ip.com/?post_type=newsletter&p=10135 MUSCAT – This is to advise that The Directorate of Intellectual Property at the Ministry of Commerce and Industry of the Sultanate of Oman has declared a circular dated 21 September 2016 informing IP agents about the activating the substantive examination.

Accordingly, each applicant or its agent should submit a request for substantive examination with respect to applications formally accepted in the year 2013-2014 within two months from the date of the notification, i.e. 21 September 2016. Said request should be accompanied by a payment of the examination fees of OMR300 (equivalent to USD780) and a photocopy of the completed formalities, which includes the application form as submitted including any amendments to the specifications, description, abstract, claims, and drawings in Arabic and English languages, as well as a photocopy of the first page of the application for publication purposes.

Failure to submit said request on or before 21 November 2016, the patent application will be considered cancelled in accordance with article 9 (5) a and b of the Industrial Property Law no. 67/2008.

This comes as a result of the signing of a memorandum of understanding between the Omani and the Egyptian Patent Offices, where the Egyptian Patent Office acts as the examining office for all pending and new patent applications filed in Oman.

Therefore, it is requested to attend to the payment of examination fees as follows:

  • The examination fees for valid applications filed during the years 2011, 2012, and 2013 must be paid within 90 days from the date of this circular, i.e. before 24 December 2014.
  • The examination fees for new applications filed after 1 November 2014, must be paid together with the filing fees or upon completing the required document since late submitting of documents of 90 days is permissible.

Please note that regulations regarding the applications filed between 1 January and 31 October 2014 have not yet been issued.

Accordingly, there will be an exchange of practices between both patent offices, and the Egyptian Patent Office (EGPO) will host researchers from the Oman Patent Office (OPTO) for training in substantive examination of patent applications in Oman. The EGPO will also send examiners to the OPTO for training purposes. Additionally, all pending patent applications in Oman will be examined by the EGPO.

Needless to say, the EGPO is an accepted examiner at WIPO and PCT offices.

Furthermore, substantive examination fees were added for patent s applications filed simultaneously for each additional invention after the first, while government tax remains the same regardless of the number of inventions.

On 1 May 2012 the Registrar has levied additional cost of Iraqi Dinar 20,000 (USD$18) as examination fees on each sub-class.

On 15 September 2012 the ITMO announced that the above imposed examination fees are not applied any more. It is important to note that any application filed during the validity of the new extra fees will remain subject for the said fees when mature to examination.

However, we have revised our schedule of charges to reflect the reductions in the official fees.
