The Decree was published in the Official Gazette number 31(B) on 6 August 2022, where EAIP should be structured and start its operations within a year from the publication date, i.e., 6 August 2023.

EAIP will replace the General Administration of Trademarks, Industrial Designs and Models of the Ministry of Supply and Internal Trade in relation to all IP matters and will fulfil its duties. It will handle all IP-related transactions and become the point of contact for applicants and agents regarding new filings, renewals, recordals, and so on.

Jordan – Administrative Courts Replace High Court of Justice https://njq-ip.com/newsletters/2014/09/jordan-administrative-courts-replace-high-court-of-justice/ https://njq-ip.com/newsletters/2014/09/jordan-administrative-courts-replace-high-court-of-justice/#respond Mon, 29 Sep 2014 08:23:38 +0000 https://njq-ip.com/?post_type=newsletter&p=8663 AMMAN – The Administrative Court of Justice has replaced The High Court of Justice by ratifying Administrative Court Law No. 27 for the year 2014, which was published in the Official Gazette No. 5297 on 17 August 2014 with an effect date 60 days thereafter.

The Administrative Court will consist of two levels, The Administrative Court and The High Administrative Court. The decisions issued by the Administrative Court will be subject to appeal before The High Administrative Court within 30 days from the date of notification.

According to Trademark, Patent, and Design law, the Registrar’s decisions were subject to appeal before The High Court of Justice in one stage only as per the previous practice. However, the most important change in the law is that now said decisions will be subject to appeal in 2 stages instead of one.

Moreover, pending cases before The High Court of Justice will be transferred to The Administrative Court.

Moving forward, the Registrar’s decisions that were issued based on the old law will now be subject to the appeal according to the new law.

Montenegro – Deadline for Trademark Recognition Soon to Expire https://njq-ip.com/newsletters/2011/10/montenegro-deadline-for-trademark-recognition-soon-to-expire/ https://njq-ip.com/newsletters/2011/10/montenegro-deadline-for-trademark-recognition-soon-to-expire/#respond Thu, 27 Oct 2011 12:15:35 +0000 https://njq-ip.com/?post_type=newsletter&p=8006 On 28 May 2008, the Intellectual Property Office of Montenegro commenced operations upon the dissolution of the Union of Serbia and Montenegro.

The new Trademarks law, which entered into force on 16 December 2010, stipulates that trademarks registered in the Intellectual Property Office of Serbia and Montenegro or in the Intellectual Property Office of Serbia before 28 May 2008 are considered valid in Montenegro, provided that the trademark holder submits an application for the recognition of the trademark with the Montenegrin Intellectual Property Office.

Please note that trademarks for which the following applications have already been submitted with the Montenegrin Office are granted an exemption from the obligation of filing the request of recognition:

  • Renewal applications.
  • Request of transfer of rights; and
  • Change of name and address applications.

16 December 2011 is the deadline for filing an application for recognition with the Montenegrin Office, otherwise, trademark registrations will be considered invalid in the territory of Montenegro.

Libya – Trademark and Patent Office Resumes its Activities https://njq-ip.com/newsletters/2011/09/libya-trademark-and-patent-office-resumes-its-activities/ https://njq-ip.com/newsletters/2011/09/libya-trademark-and-patent-office-resumes-its-activities/#respond Tue, 27 Sep 2011 17:47:25 +0000 https://njq-ip.com/?post_type=newsletter&p=7982 Tripoli – Our staff at the NJQ Libya office have visited the Libyan Trademark and Patent Offices and ascertained that as a result of placing protection over public properties by the National Transitional Council, the offices have not suffered any damage during the recent Libyan revolution and the files remain unharmed.

Although some of the employees have resumed their duties, the offices are not receiving any applications at the current time.

According to the officials, the offices will be fully operational at the beginning of October 2011, and they also confirmed that any deadlines falling between the commencements of the revolution until now will be extended for a further two months from the date of resuming operations.

The Iraqi Authorities had issued new regulations to amend the Patent Law, the main aspect of this amendment are as follows:

  1. Extending the period of protection from 15-20 years.
  2. Beginning the protection as of filing or priority date as it was from acceptance earlier.

Since the beginning of the war, no Patents’ Letters were issued in favor of any application, however, our office has received the first Patent’s Letter issued under the new regulations.

Trademark Office (ITMO)
ITMO had issued a new requirement relating to the power of attorney in respect of applications under prosecution which were filed before the war, in which it requests to submit a certified/ original power of attorney legalized up to the Iraqi Consulate in order to pursue any pending application.

A new Law will be issued shortly in which the expected changes would be amending the protection period for filing and renewal to be 10 years instead of 15. Service marks from 35-45 are going to be applied instead of 42.

The matter of boycott declaration is still under negotiations, decision has not been issued yet relating thereto.

Moreover, the procedure of re-constitution of files is still open and no deadline had been set off. It is recommended for all trademark proprietors to attend to do so in order to avoid the risk of registration of conflicting or similar new applications.
