PoAs and other required documents no longer need to be legalised by the Consulate of the UAE, i.e., notarization of the same will suffice.

A stamp of a UAE public entity (e.g. government organisations, national universities) is now regarded as equivalent to notarization.

In addition, if the inventor is an employee of a UAE company, it is possible to submit a certificate of employment or a copy of the employment contract instead of the deed of assignment.

  • New trademark applications will only be accepted if accompanied by a legalised PoA (late filing within 3 months is no longer permissible);
  • Recordals to change name, address, assignments, mergers, etc . are only allowed after the registration of the subject trademark; however, corrections of typos are the only accepted type of modifications to a non-registered trademark (during prosecution of the application), and
  • Oppositions must include a PoA when initiating an opposition against a published mark.

Those requirements were mentioned in the Ordinance 03-06 dated 19 July 2003, however, the Registrar used to accept original deeds of assignment or certified copies of merger and change of name documents in order to facilitate smooth procedures, but the Trademark Office decided to require legalisations and sworn translations in order to prevent illegal acts.

Please be informed that any document legalized up to the Omani Consulate prior to the date of the joining of Oman to the said Convention is still acceptable.
