The said application was published on 1 July 2008 subject to opposition within 2 months.

On behalf of our client, A. LOACKER S.p.A. – AG, an Italian company, we filed an opposition against the above trademark application based on various previous registrations in Qatar and abroad, as well as on the confusing similarity with its own well-known trademark “LOACKER”.

After several hearings and a full trial, a Decision was made in favor of our client by accepting the opposition and stopping the registration procedure of the trademark JACKER, no. 36984, in the name of Oriental Food Industries Sdn Bhd.

The Tamween Al Khaleej Est Safa a Kuwaiti company filed a trademark application for JACKER, under No. 078711 in class 29 dated 13 August 2007, in respect of all goods in class 29. The application was published in the Trademark Journal on 20 July 2008, subject to opposition within 1 month.

Our client, A. LOACKER S.p.A. – AG, an Italian company, opposed the above trademark based on confusing similarity with its well-known trademark LOACKER in class 30, and the registration of similar trademarks in the name of a third party, even if the class and list of goods are different, could confuse the public to its origin.

After several hearings and a full trial, a Decision was made in favor of our client by accepting the opposition for the above reasons.
