LIBYA: THE TRADEMARK OFFICE RESUMED THE ISSUANCE OF THE OFFICIAL GAZETTE

TRIPOLI – On 23 September 2020, the Trademark Office (TMO) of Libya issued its Official Gazette number one (1) for the year 2020, which opens a 3-month opposition period. Therefore, the first deadline to oppose is 22 December 2020.

The total number of published applications is 224 and the TMO is expected to issue more gazettes during 2020 to overcome the backlog. The last issued gazette by the Libyan TMO was on 4 June 2015.

Libya – Issuance of Trademarks Journal

Despite the unrest in Libya, the Ministry of Justice Printing Press was able to issue two (2) new Official Gazettes relating to the publication of trademarks, edition number 1 dated 14 January 2015 and edition 2 dated 20 January 2015, both open for an opposition period of three (3) months from the publication date.

Italy – Opposition Period is Now Available

As of 1 May 2011, any trademark application filed on or after this date will be subject to an opposition period of three (3) months from the date of publication in the official gazette. Previously, there was no opposition stage and any interested party could file a cancellation action at the court.

According to the above, any trademark filed before the said date can be contested by a third party by means of submitting a cancellation action at the court.
