Jordan – Conflict between SILVERSTONE and BRIDGESTONE

AMMAN – Our client, Silverstone Berhad, filed a trademark application for SILVERSTONE in class 12 on 8 June 2010 under number 112550; the application published for opposition on 30 September 2010 for a period of 3 months.

The Malay manufacturer, Bridgestone Corporation, and the owner of the trademark BRIDGESTONE in Jordan, filed an opposition against the above trademark application based on the similarity between BRIDGESTONE and SILVERSTONE in terms of pronunciation, general appearance, and designated goods.

Acting on behalf of our client, we have submitted evidence to the court in our defense arguing involving the following:

Differences in the general appearance and design between the two trademarks;
Our client has prior registration of SILVERSTONE in home country (i.e. Malaysia) since 1990, and
World-wide registrations of the SILVERSTONE since 1992.

After reviewing the evidences in hand and considering the above facts, the Trademark Registrar issued his decision in our favour allowing the trademark for registration; thereupon the opponent’s application has been abandoned.

Kodak Patent Case Against Apple, RIM Sent Back to Judge

A ruling on Eastman Kodak’s patent case against Apple and Research In Motion (RIM) may be delayed until August after the U.S. International Trade Commission sent the issue back to a judge who had earlier ruled against Kodak. The patent at issue relates to camera-phone image previews.

The suit, which aims to block Apple and RIM from importing iPhone and Blackberry phones, was filed by Kodak in January last year. It alleges that Apple and RIM infringed its patents with a feature that allows image previews on their phones. The ITC agreed to investigate the claim in February last year.

United Arab Emirates (UAE) – Issue Related to Judgment and Decision

ZYDENA vs. ZIDONYL
Our client, DONG-A PHARMACEUTICAL CO., LTD, a Korean company, filed the trademark application ZYDENA in the United Arab Emirates (UAE) , filing No. 84077 dated 12 August 2006, in Class 5 in respect of Pharmaceuticals and medicine for the treatment and behavior of sexual dysfunction; Pharmaceuticals and medicine for sensory organs; Pharmaceuticals and medicine for the central nervous system ; Pharmaceuticals and medicine for the urogential organs; Pharmaceuticals and medicine for the circulation.

The above application was published on 9 September 2007.

Al Khalij Company for Pharmaceutical Industries opposed the above application based on confusing similarity with its trademark ZIDONYL, and claiming that both marks are in the same class, and this will give the impression to the public of a connection between them.

After several hearings and a full trial, a Decision was made in favor of our client and rejected the opposition for reasons stating that the similarity between both trademarks is not sufficient to confuse the public.
