Eritrea – IP Protection Procedure https://njq-ip.com/newsletters/2009/09/eritrea-ip-protection-procedure/ https://njq-ip.com/newsletters/2009/09/eritrea-ip-protection-procedure/#respond Mon, 14 Sep 2009 14:03:00 +0000 https://njq-ip.com/?post_type=newsletter&p=7551 As you may know, an IP law is under issuance for a long time, and until it comes into force, the protection is sought only through publication of a cautionary notice.

This procedure is interrupted by the government from time to time, which issues orders to the local newspapers not to accept such advertisements.

Before proceeding in publishing a cautionary notice, an approval from the competent authority must be obtained first, and then the newspaper will place the advertisement.

The above procedure will serve as proof of prior right in case of conflict or infringement, and the local courts have accepted such evidence in issuing its judgment.

As of 25th August 2009, the Eritrean government has put a hold on publishing of cautionary notices for undisclosed reasons.

We will update you with the developments once they have occurred.
