Yemen – Increase in Official Publication Fees https://njq-ip.com/newsletters/2014/07/yemen-increase-in-official-publication-fees/ https://njq-ip.com/newsletters/2014/07/yemen-increase-in-official-publication-fees/#respond Tue, 29 Jul 2014 16:42:04 +0000 https://njq-ip.com/?post_type=newsletter&p=8653 SANA’A – This is to inform you that the Ministry of Industry & Trade in Yemen has on, 1 July 2014, issued a Ministerial Decree No. 105/2014 announcing an increase of $50 to $100 on the official publication fees for new trademarks, patents, and designs based on the required space reserved for the advertisement.

The effective date of said Decree is 7 August 2014.

It is required that any accepted applications are published twice, the first time after acceptance and subject to the opposition period of 90 days, and the second publication comes after payment of the registration fees. The increase of fees covers both advertisements.

The new charges are reflected on all new applications including filings, renewals, recordals, and amendments, as well as the registration of patents and designs.

In light of the above, it is worth mentioning that all applications filed before the effective date will not incur the increased charge.

The Decree provides an allowance period of 3 months fo all IP departments to complete pending files. Any remaining incomplete applications after this time period will be subject to the new fee.

Saudi Arabia – Payment of Publication Fees https://njq-ip.com/newsletters/2014/02/saudi-arabia-payment-of-publication-fees/ https://njq-ip.com/newsletters/2014/02/saudi-arabia-payment-of-publication-fees/#respond Wed, 26 Feb 2014 21:45:09 +0000 https://njq-ip.com/?post_type=newsletter&p=8446 RIYADH – This is to advise that the Registrar of the Trademark Office in Saudi Arabia has issued a circular letter on 12 February 2014 stating that advertisement fees must be paid within 30 days from the date of acceptance. Failing to do so will result in the abandonment of the application.

This new regulation replaces the previous practice, which did not have a time limit to pay the advertisement fees.

As for old pending applications, the advertisement fees must be paid before the end of February 2014, otherwise they will be considered lapsed.

It is worth mentioning that the date of the Gazette is 20 May 2013, however, it was distributed on 28 May 2013, and the opposition period ends on 19 August 2013.

After a trademark application has been examined, instead of being published in the Official Gazette (Um Al Qura) it must be published online on the specially designed website by the Saudi Arabian Intellectual Property Office for that purpose.

Accordingly, the official fees for publication have been increased from SR 540 to SR 1000 (USD$ 144 to USD $ 267).

This new regulation became effective on the above mentioned date and will apply to new applications as well as applications pending publication.

Before this amendment, the publication and registration fees are to be paid within one month. Now the payment of official fees for publication and registration will proceed as follows:
First: Publication fees for accepted trademarks shall be collected within 30 days of the applicant being notified of accepting the trademark application.

Accepted trademarks shall be published in the ministry trademarks bulletin and other two local newspapers within 30 days from the approval of the publication form; otherwise the application shall be considered cancelled.

Second: final registration fees for published trademarks shall be collected within 30 days from the expiry of the 30 day opposition starting from the last publication date as per Article 14 of the Federal Law No. 37 of 1992 on trademarks.

Third: This resolution shall be published in the official gazette and shall be effective as of the date of issuance.

Fourth: The Resolution was issued in Abu Dhabi on 14 February, 2010.

The ministerial resolution became effective as of January 1, 2005. Hereunder we summarize the main points of this resolution:

Payment of Publication Fees:
The Trademark Office imposed a fine of US$ 14 for each month’s delay in the payment of publication fees of an accepted mark, with a maximum fee of US$ 137 for a one-year delay. In the past, it was stipulated to pay the publication fees of an accepted mark within sixty days from issuance of the Examiner’ s acceptance decision. Failure to do so used to result in the cancellation of the mark.

Payment of Registration Fees:
The Trademark Office imposed a fine of US$ 137 for each month’s delay in the payment of registration fees, with a maximum fee of US$ 1362 for a one-year delay. According to the old practice, registration fees should have been settled within sixty days after the expiry of the one month opposition term. Failure to comply within the specified period used to result in the cancellation of the mark.

Renewal Fees:
The official fees of a renewal application were increased by US$ 69 if filed during the last year of the protection period.
The official fees of a renewal application were increased by US$ 136 if filed during the three months grace period.
