RAMONS VS. RAMONES

 

Our client, the Turkish company, “RASA TEKSTIL SANAYI VE TICARET LIMITED SIRKETI”, has instructed us to file an opposition against Moroccan trademark application No. 132564 “RAMONES in Latin characters and device in color” in classes and list of goods 23; 24; and 25, in the name of “ALBA MODE”.

The opposition was based of the following facts:

  • Our client first registered his mark in Turkey on 21 September 2005.
  • We have IT registration No. 874917 dated 04 October 2005 in same classes.
  • Similarities between the two trademarks.
  • The opposed mark is identical to our client’s and is registered in bad faith.

After full prosecution, the registration procedure of the conflicting trademark “RAMONES” has been cancelled. This decision is subject to appeal before the Supreme Court within 20 days.
