Accordingly, any applications that have matured to registration (published and no oppositions raised) and that are still valid, a registration certificate will issue once payment of the official fees of LYD151 (approximately USD111) has been made.

As for expired applications, it is possible to issue renewal certificates after paying the normal renewal fee of LYD181 (approximately USD133) per application.

It is been stated that the filing number will become the registration number of the mark. This new change will apply to pending applications as well as new ones.

Owners of these numbered trademarks are requested, through their trademark agents and legal attorneys, to provide the Trademark Office with documents proving that they are the legitimate owners of these trademarks within a deadline of six months from the above date.

Earlier in year 2003, and immediately after the end of Iraqi War, NJQ had dealt with this subject with much care and sent several circular letters to its clients requesting owners of old trademarks to rebuild the damaged files.

Following the recent regulations of border measures, it is possible now to register trademarks at customs department. This registration will serves as a circular to all custom boarders to watch incoming shipments of goods suspected of bearing false or counterfeited products or similar or identical trademarks. Customs officials will confiscate any products alleged of being counterfeited and will inform the registered trademark owner to take legal action within 10 days.

Registraion with the customs’ requirements are:

  1. Power of attorney legalised up to the Sudanese consulate at your end.
  2. Certified copy of trademark registration certificate in Sudan, can be obtained by us.
  3. Samples or photocopies of the original products.

Please note that registraion with customs is valid for ONE year and can be renewed annually.

The first certificate of registration has been issued on May 25, 2010 in favor of “Standards and Specifications Center” (governmental department).

The trademark Office has promised to commence issuance of all certificates, finalizing the first 1000 certificate, then to be followed by the same number afterwards and so on.

It is worth mentioning that all trademarks which have been accepted and published in the official gazettes are considered registered and ready for issuance of registration certificates, if there was no opposition filed.

The first certificate of registration has been issued on 25 May 2010.

The trademark Office has not indicated yet when they will be commencing issuance of all other pending certificates, but it is expected to be resumed shortly.

It is worth mentioning that all trademarks which have been accepted and published in the Official Gazette are considered to be registered trademarks if there was no opposition filed.

We have written to the Libyan authorities complaining about the new requirement asking to abandon this document. After several attempts we succeeded in convincing the authorities to accept filing the applications with certified copies of home registration only without legalization up to the Libyan Consulate which takes longer time. This procedure will save time, effort and paying extra money and well expedite the process of filing there.

The content of which are:

  1. Publication and registration fees for a trademark application must be paid within 30 days from the date of the issuance of the notification of acceptance. Failing to do so will subject the application to a penalty of late payment of publication fees of AE50 per month, and registration fees of AE500 per month with no maximum limit.
  2. Registration fees are refundable any time before the end of the opposition period, which is 30 days from the publication date.

It is worth mentioning that publication fees are AE500 (US $137) and registration fees AE5000 (US $1370).

In this regards the trademark’s applicants are requested to settle the trademark registration fees in a certain period of time to avoid the aforementioned extra charges.
