Our client, Seiko Kabushiki Kaisha (trading as Seiko Corporation), a Japanese company, filed an opposition against the above trademark based on the SEIKO trademark, it being very well-known, and that the trademark “SEIKO SEIKO” is similarly confusing.

The opposition was based on the fact that any well-known trademark should not be registered by a third party even if the class and list of goods are different, since it could mislead the public as to its origin.

After several hearings and a full trial, the Registrar issued his Decision by accepting our opposition, and stopped the registration procedure of no. 99440 SEIKO SEIKO in the name of Alawda for Biscuit and Sweet.
