Our client, UGUR SOGUTMA MAKINALARI TEKSTIL SERIGRAFI BASKI MADEN VE MERMER SANAYI VE TICARET ANONIM SIRKETI, a Turkish company is the owner of the registered trademark UGUR in Class 11 in the home country and worldwide since 1992.

It came to our client’s attention that its previous distributor in Saudi Arabia, Mohammad Imad Eddin Waheeb Al Byriqdar, had registered the same trademark under number 50/1056 in class 11 in Saudi Arabia.

Acting on behalf of our client, we filed a cancellation action in the Board of Grievance against said registration based on bad faith.

Our argument stressed that there was a clear intention of bad faith by the defendant, demonstrated by the fact that he was the commercial distributor of our client in Saudi Arabia.

We supported our argument by submitting the following evidences:

  • Copy of sales invoices in the name of the infringer, and
  • Copy of the correspondences between our client and the defendant.

After several hearings, the Board of Grievance in Saudi Arabia issued its decision to our favor by removing the infringing trademark from the register. The counterparty did not file an appeal against the decision, therefore the decision became final.

Our Client’s above trademark was provisionally partially refused due to the citation of trademark UGUR filed under No. 215135 in Class 11 in the name of Mohammad Imad Eddin Waheeb Al Byriqdar.

Accordingly, we filed an appeal against the provisional refusal decision based on the following:

  1. Our client is the legitimate owner of the trademark “ugur” in home country and abroad.
  2. Our client has prior use and registration of his trademark in home country and other countries around the world.
  3. The refusal decision is based on an invalid trademark which has been previously opposed and cancelled by our client.

The Registrar, after reviewing the above merits and the supporting the documentary evidences thereof, has issued his favorable decision accepting our appeal and proceeding with the registration of International Trademark “ugur & device” No. 779950 in Class 11 in the name of our Client.

We submitted an opposition against the said mark on behalf of our client “UGUR SOGUTMA MAKINALARI TEKSTIL SERIGRAFI BASKI MADEN VE MERMER SANAYI VE TICARET ANONIM SIRKETI” based on the following:

  • Our client is a worldwide active business in exporting this well-known brand.
  • They have used this trademark intensively in Turkey and abroad and have a registration of this trademark in their home country since 1998.
  • Our client’s trademark “UGUR” is registered through WIPO as of 2001, designating Egypt.
  • Additionally, our client has used his trademark in Egypt before the date of filing of the infringing trademark.
  • The opposed mark is our client’s trade name and has identical similarity which could lead to a possible confusion between the two.

Based on the above, and after full prosecution, the Opposition Committee has issued its decision in favor of our client.
