TRIPOLI – The Ministry of Commerce and Trade announced that it will commence its operations and start accepting new trademark applications on 2 September 2024.

This comes after a closure of many years due to civil unrest.

Libya – Filing of the First Trademark Renewal Application

The Libyan Trade Mark Office (LTMO) was closed due to the national war from February 2011 to 14 April 2013.

Since the beginning of the LTMO’s operation in 2002 through today, no registration certificates have been issued. Since the registration period is 10 years from the filing date, many applications published and have matured to registration. Accordingly, many trademarks were due for renewal during the closure of the LTMO.

Now, the LTMO has confirmed that it is possible to file renewal applications for expired trademarks and renewals coming before the end of this year and those due in year 2014.

It is still not clear if a grace period will be announced for late renewal or whether there will be penalty charges.

Libya – Trademarks Updates

This is to advise that the Libyan Trademark Office (LTMO) has issued the first Trademark Journal after the revolution and the resuming of operations on 16 April 2013.

It is worth mentioning that the date of the Gazette is 20 May 2013, however, it was distributed on 28 May 2013, and the opposition period ends on 19 August 2013.

Libya – The Trademark Office has Resumed Operations as of 16 April 2013

We are pleased to announce that the Libyan Trademark Office (LTMO) resumed its operations on 16 April 2013, after the closure of this office due to revolution. We are proud to announce that we have successfully filed the first application since the re-opening of the office for the mark “STEELMASTER” under No. 22102 in Class 2 on 16 April 2013.

According to the new regulations, all documents executed before or during the revolution need to be revised, e.g., any document bearing the consulate stamp of Great Socialist People’s Libyan Arab Jamahiriya are no longer accepted. The stamp should now indicate the State of Libya; therefore, we kindly request our clients to send revised documents as soon as possible, in order to avoid unnecessary delays.

Additionally, the LTMO has revised the application requirements and they are now:

Power of attorney legalized up to Libyan Consulate, and
Certified copy of the commercial registrar legalized up to Libyan Consulate.

It’s worth mentioning that a legalized copy of home/foreign registration certificate is not required anymore.

Libya – Trademark Office Update

TRIPOLI – Please be informed that the Libyan Trademark Office staff have resumed their duties earlier this month. They have some administrative back-log work to handle, and are yet to receive new applications.

Our office in Libya is monitoring the situation and will inform our valued clients once the office is back to full operational status. In the meantime, our clients can still send us their instructions for Libya to libya@qumsieh.com and we will docket the same on our systems and keep it pending for further notice.

Libya – Patent Office Resumes Activities

Tripoli – Our staff has visited the Libyan Patent Office and confirmed that many of the employees have resumed duty.

Further, our staff was successful in filing two PCT applications.

Libya – Intellectual Property Office Operations

The Libyan Intellectual Property Office is dysfunctional, obviously, due to the unrest in Libya.

It is worth mentioning that the IP Office is located in the city of Tripoli, the capital of Libya.

We do not have any information as to when the office might become operational, however, our team is working and preparing all documents required for procedures to be submitted as soon as the TMO resumes duties.

This is to inform you that the Intellectual Property Office in Egypt is now partially operational; all deadlines are still kept on hold. However, our office is now fully operational and can reply to clients’ requests and queries.

Egypt – Trademark Office Circumstances

It has been officially announced that since all governmental offices are not operational due to the current event in Egypt, all deadlines that occur during this period, or will fall due in the near future, will be automatically postponed until the situation becomes settled.

Accordingly, clients and associates do not have to worry about due dates for submitting responses, documents, appeals, or priority dates if the deadline occurs starting from 25 January 2011, until further notice.
