Trademarks - Filing Requirements


Filing Requirements
  • Power of attorney, legalised or apostilled.
  • Certified copy of the extract from the Commercial Register. If the applicant is individual, then it is required to obtain a letter from the Chamber of Commerce where the applicant resides stating that he/she is a business man engaged in business or trade activities.
  • Certified copy of the priority document if claimed.

Notes
  • Late filing of documents: can be filed later without penalty.

Renewal Requirements
  • Power of attorney, legalised or apostilled.

Notes
  • Late filing of documents: not allowed.

A letter demonstrating that the power of attorney (PoA) is for the purposes of Renewal only should accompany renewal applications. Alternatively, a general PoA can be submitted while referencing within the renewal application that the purpose of the PoA is to change the agent on record for the subject trademark.

Assignment Requirements
  • Power of attorney, legalised or apostilled.
  • Deed of assignment document from the assignor and the assignee legalised or apostilled.
  • Certified copy of the certificate of incorporation or the extract from the commercial register of the assignee.

Merger Requirements
  • Power of attorney, legalised or apostilled.
  • Merger agreement document legalised or apostilled.
  • Certified copy of the certificate of incorporation or the extract from the commercial register.

Notes

Recordal of Change
  • Power of attorney, legalised or apostilled.
  • Certificate of change of name legalised or apostilled.
  • Certified certificate of the change of address.

Notes
  • Late filing of documents: not allowed.

License Requirements
  • Power of attorney, legalised or apostilled.
  • License agreement document containing the trademark registration number, legalised or apostilled.
  • Certified copy of the certificate of incorporation or the extract from the commercial register of the licensee.
