New inventions shall be patentable if they involve an inventive step and are industrially applicable, regardless of the nature of the products and the processes used and whatever the technological field they apply to. New inventions shall be patentable even if they involve a product composed of biological material, or which contains biological material, or a process which allows for the production, treatment or use of biological material.
An invention shall be considered new if it does not form part of the state of the art. It shall be considered that an invention involves an inventive step if, for a person skilled in the art, that invention would not have been obvious from the state of the art and the invention shall be considered industrially applicable if it can be made or used in any kind of industry.
