Copyright shall subsist throughout Swaziland for the term hereinafter mentioned in every original literary, dramatic, musical and artistic work, if:
(a) in the case of a published work, the work was first published within a part of the British Commonwealth to which the Copyright Act, 1911 of the United Kingdom (1 and 2 Geo. 5 ch. 46) applies; and
(b) in the case of an unpublished work, the author was at the date of the making of the work a British subject or resident within any such part of the British Commonwealth as aforesaid;
Where, in the case of an unpublished work, the making of a work has extended ‘over a considerable period, the conditions .of this Act conferring copyright shall be deemed to have been complied with, if the author was, during any substantial part of that period, a British subject or a resident within the parts of the British Commonwealth to which tile Copyright Act, 1911, of the United Kingdom, extends.
