Patent Filing Requirements
Notes
There are two ways to file patents applications:
1- Local patent application.
2- UK-based application which extend the owner's rights in Montserrat under a UK registration effective from the date of the registration in the UK.
For a local application, the following documents are required:
1- Power of attorney, notarised.
2- Description of the patent.
3- Specification, claims, formal drawings, and abstract.
For a UK-based or a Community-based application, the following documents are required:
1- Power of attorney, notarised.
2- Certified copy of the UK or Community patent.

For a UK-based or a Community-based application, the following documents are required:
1- Power of attorney, notarised.
2- Certified copy of UK assignment certificate, notarised.

Patent Merger

For a UK-based or a Community-based application, the following documents are required:

2- Certified copy of the UK merger deed, notarised.

Patent Recordal of Change
Notes
For a local application, the following documents are required:
1- Power of attorney reflecting the new name or address , notarised.
2- Certified copy of the certificate of incorporation or an extract from the commercial register reflecting the change, notarised.
For a UK-based or a Community-based application, the following documents are required:
1- Power of attorney reflecting the new name or address, notarised.
2- Certified copy of the UK recordal document reflecting the change, notarised.

Patent License
Notes
For a local application, the following documents are required:
1- Power of attorney signed by the licensee, notarised.
2- License agreement document signed by both parties, notarised.
For a UK-based application, the following documents are required:
1- Power of attorney signed by the licensee, notarised.
2- Proof of recordal of registered user against the UK registration, notarised.
