Trademarks - Filing Requirements


Filing Requirements
  • No documents are required.

Registration with Customs Duty
  • Registration number of the trademark in the U.S. Patent and Trademark Office.
  • Digital images of the protected mark in ".jpg" or ".gif" formats that accurately depict the right to be protected. Each image file size should not exceed 2MB.
  • Five copies of the status of the certificate of registration certified by the U.S. Patent and Trademark Office showing the title to be presently in the name of the applicant. The copies may be reproduced privately and shall be on paper approximately 8′′×101⁄2′′ in size. If the certificate consists of two or more pages, the copies may be reproduced on both sides of the paper.

The process established by Customs Authorities (CBP) to notify both the importer and the mark's owner about possible illegal imports of products bearing US registered marks applies only to trademark holders who have duly registered their trademark rights with the U.S. Patent & Trademark Office and recorded same with U.S. Customs. There is a process established by Customs Authorities (CBP) to notify both the importer and the mark's owner about possible illegal imports of products bearing US registered marks. This process was clarified on April 2012 after CBP issued its IPR Interim Final Rule, and may lead to a detention and seizure of the imported products.

The required documents must be available and supplied upon request by CBP. Failure to supply documents upon request by CBP will result in your recordation being suspended pending receipt of the documents.

Renewal Requirements

Assignment Requirements
  • Power of attorney signed by the assignee.
  • Deed of assignment document signed by the assignor and assignee.

Merger Requirements
  • Power of attorney simply signed.
  • Merger agreement document signed by both parties.

Recordal of Change
  • Power of attorney reflecting the new name or address simply signed.
  • Certificate of incorporation or extract from the commercial register reflecting the change.

License Requirements
  • Power of attorney signed by the licensee.
  • License agreement document signed by both parties.
