Trademarks

The rights of a proprietor of a registered trademark shall consist in the faculty of making exclusive use of the mark. The proprietor shall have the right to prohibit other persons, not having his authorization, from using:

(a) a sign identical with or similar to the registered mark, for identical or related goods or services if, due to the fact that the signs are identical or similar and the goods or services are identical or related, there exists a likelihood of confusion on the part of the public, which may also consist in a likelihood of association between the two signs;

(b) a sign identical with or similar to a mark registered for goods or services that are not related, if the registered mark enjoys repute in the State and if use of the sign without due cause takes unfair advantage of or is detrimental to the distinctive character or the repute of the mark.
