Trademarks - Filing Requirements


Filing Requirements
  • Power of attorney simply signed.

Notes
  • Late filing of documents: allowed within 2 months from filing date without penalty.

Registration with Customs Duty
  • A specific form completed with accurate and detailed information about the subject trademark, its owner, and the geographical scope for monitoring (Italy or European Union if it concerns a Community trademark) should be filed (no time limit, but monitoring does not run retroactively) together with copy(ies) of the trademark(s) to be monitored and a power of attorney.

  • Late filing of documents: not allowed.

A trademark can be recorded with the Customs for monitoring purposes (of goods suspected of infringing trademark rights).

Renewal Requirements
  • Power of attorney simply signed.

Notes

Assignment Requirements
  • Power of attorney simply signed.
  • Assignment Declaration must be signed by both parties and then registered at the Italian fiscal authorities (i.e. the Italian Registry Office), after which the recordal request can be filed with the Italian Trademark Office.

Merger Requirements
  • Power of attorney simply signed.
  • Merger agreement document.

Notes

Recordal of Change
  • Power of attorney simply signed.

Notes
  • Late filing of documents: not allowed.

License Requirements
  • Power of attorney simply signed.
  • Simple declaration executed by both the licensor and the licensee stating that the trademark has been licensed, said declaration must include full details of the trademark application(s) and/or registration(s) concerned.

Notes
  • Late filing of documents: allowed within 2 months from filing date without penalty.

In addition, before the recordal of the license is applied, the above declaration must be registered with the competent fiscal authorities (i.e. the Italian Registry Office).
