A design is considered new if no identical design (or with insignificant changes) was disclosed prior to the date of filing the application for registration of the same.

The design shall be considered public if it has been made accessible to the public not only as a result of a deposit /registration, but also has been exposed, marketed or published in any other way before the date of submission of the application for registration or, if priority is claimed, before the date of priority.
