For the protection of distinctive signs, the following industrial property rights shall be granted in accordance with this Law:

(a) trademarks;
(b) trade names.

Applications, grants and the other legal acts or business affecting the rights indicated in the previous subparagraph shall be entered in the Register of Trademarks, according to the provisions of this Law and the Regulations relating thereto.

The Register of Trademarks shall be unique throughout the national territory and shall be kept by the Spanish Patent and Trademark Office, without prejudice to the powers entrusted to the Autonomous Communities in the enforcement of industrial property laws.
