Patents - Filing Requirements


Patent Filing Requirements
  • Power of attorney duly notarised and legalised by means of the Apostille or by the Argentinean Consulate.
  • Certified copy of the priority document (if claimed) with certified Spanish translation.
  • Specification, claims, figures or drawings, and sequences if any.
  • Deed of assignment signed by both the assignor and the assignee legalised with certified Spanish translation.
  • Certificate of deposit of microorganisms.

Notes
  • Late filing of documents: allowed within 40 days from filing date without penalty.
  • Extension of time for late filing of documents: not allowed.

Late filing of the rest of the documents is possible for within 90 days from filing date without penalty.

Annuity Requirements
  • No documents are required.

Patent Assignment
  • Power of attorney duly notarised and legalised by means of the Apostille or by the Argentinean Consulate.
  • Deed of assignment signed by both the assignor and the assignee legalised with certified Spanish translation.

  • Late filing of documents: allowed within 40 days from filing date without penalty.
  • Extension of time for late filing of documents: not allowed.

Patent Merger
  • Power of attorney duly notarised and legalised by means of the Apostille or by the Argentinean Consulate.
  • Merger agreement signed by both parties legalised with certified Spanish translation.

Notes
  • Late filing of documents: allowed within 40 days from filing date without penalty.
  • Extension of time for late filing of documents: not allowed.

Patent Recordal of Change
  • Power of attorney reflecting the change, simply signed.
  • Official proof of the change issued by the relevant authorities, legalised by the Argentinean Consulate with certified Spanish translation.

Notes
  • Late filing of documents: allowed within 40 days from filing date without penalty.
  • Extension of time for late filing of documents: not allowed.

Patent License
  • Power of attorney duly notarised and legalised by means of the Apostille or by the Argentinean Consulate.
  • License agreement signed by both parties legalised with certified Spanish translation.
