Trademarks - Filing Requirements


Filing Requirements
  • Power of attorney duly legalised by the Honduran Consulate or Apostille.
  • Applicant details, mark, class and list of goods.
  • Certificate of incorporation or extract from the commercial register legalised by the Honduran Consulate.

Notes
  • Late filing of documents: within 1 month without penalty.
  • Extension of time for late filing of documents: 15 days with penalty

Registration with Customs Duty

Notes
In Honduras it is not possible to register trademarks before the Custom’s Authority. This is however a requirement under DR-CAFTA and therefore the enactment of pertinent regulations to this end cannot be discarded in the not so distant future.

Renewal Requirements
  • Power of attorney duly legalised by the Honduran Consulate or Apostille.
  • Copies of payment receipts of annuity tax. Scanned copies of these documents are required to be filed in support of the renewal application.

Notes
  • Late filing of documents: within 1 month without penalty.

Please be advised that any trademark registrations are subject for the payment of annuities/maintenance fees every year for the whole validity of registration. The maintenance fees are different from renewal fees.

This can be paid every year or an advanced single payment to cover the 10 years, alternatively, it is possible to attend for the payment on renewal due date.

Search Requirements
  • No documents are required.

Assignment Requirements
  • Power of attorney duly legalised by the Honduran Consulate or Apostille.
  • Certificate of incorporation or extract from the commercial register of the assignee legalised by the Honduran Consulate.
  • Registration certificate for endorsement.

Notes
  • Late filing of documents: not allowed.

Merger Requirements
  • Power of attorney duly legalised by the Honduran Consulate or Apostille.
  • Original or certified copy of the merger document, duly notarised and legalised by the Honduran Consulate or Apostille.

Notes
  • Late filing of documents: not allowed.

Recordal of Change
  • Power of attorney duly legalised by the Honduran Consulate or Apostille.
  • Certificate of incorporation or extract from the commercial register reflecting the change legalised by the Honduran Consulate.
  • Registration certificate for endorsement.

License Requirements
  • Power of attorney duly legalised by the Honduran Consulate or Apostille.
  • Original or certified copy of the license agreement duly legalised by the Honduran Consulate or Apostille.
