Iraq follows a multi-class filing system and each class is divided into sub-classes. Additional government fees of US$75 are applicable for each additional sub-class regardless of the number of classes.
On 3 April 2016, the Iraqi Ministry of Health sent a new regulation to the Trademarks Office in the Ministry of Industry and Minerals requesting that all trademark applications applied for in class 5-a (subclass a since Iraq follows multi-class filing system and each class is divided into sub-classes) should contain the following information in order to proceed to registration:

Further, when filing in Class 5-a, applicants should submit a copy of the trademark registration in the home country or abroad (in case there is no registration in the home country).

- Scientific name of the product;
- Trade name of the producer;
- Pharmaceutical formula of the product;
- Name of manufacturing company if not the applicant, and
- Name of local distributor, if any.

- Merger agreement document signed by both parties, legalised by Iraqi Consulate.

Recordal of Change
- Power of attorney reflecting the new name or address, legalised by the Iraqi Consulate.

License Requirements

- License agreement document signed by the licensee legalised.
- Certificate of incorporation or extract from the commercial register of the licensee.
Notes
Recording of the license of use agreements is not possible on trademarks registered in classes 1 to 34 in the case where both the licensee and the licensor are in the commercial and not in the industrial sector. In addition, the licensee's activities must match the services for which the trademark is registered.
