Trademarks - Filing Requirements


Filing Requirements
  • Power of attorney simply signed.
  • Certified copy of the priority document if claimed.

Registration with Customs Duty
  • Copy of the registration certificate of the subject mark.

Notes
Marks can be filed at the Customs Office; this is called filing a Customs Notice which can be filed at any time during the life of the trade mark and should be renewed when a mark is renewed.

The applicant should submit a security for costs form and a bond which is repayable if the Customs Notice is withdrawn.

Renewal Requirements
  • Power of attorney simply signed.

Notes
  • Late filing of documents: not allowed.

Assignment Requirements
  • Power of attorney signed by the assignee.
  • Deed of assignment document (with translation if the assignment is not in English), photocopies are accepted.

Merger Requirements
  • Power of attorney simply signed.
  • Merger agreement document signed by both parties.

Notes
  • Late filing of documents: not allowed.

Recordal of Change
  • Power of attorney simply signed.
  • Certificate of change, notarised.

License Requirements
  • Power of attorney simply signed.
  • License agreement document signed by both parties.
