Trademarks - Filing Requirements


Filing Requirements
  • Power of attorney simply signed.
  • Certified copy of the priority document if claimed, with Spanish translation.

Notes
  • Late filing of documents: not allowed.

A scanned copy of the power of attorney will suffice.

Registration with Customs Duty
  • Power of attorney legalised by the Panamanian Consulate or apostilled.
  • A document showing the full name of the legal owner of the trademark and its general information. If a natural person, the document should indicate the name, nationality, address, and owner's identity number. In the case of corporations, it must show the name, place of incorporation, and street and mailing addresses. In both instances, the protected right's description and specification must be included, and the name, general information, and address of the legal representative in Panama and address of the licensees and authorised distributors.
  • Certified copy of the registration certificate.
  • Samples of the genuine goods, if available, or coloured photographs or drawings presenting the goods. This will become part of the Sample Deposit.

Renewal Requirements

  • Deed of assignment document signed by the assignor and assignee, with Spanish translation, legalised or apostilled.

Merger Requirements
  • Power of attorney simply signed.
  • Merger agreement document signed by both parties, with Spanish translation, legalised or apostilled.

Recordal of Change
  • Power of attorney reflecting the change simply signed.
  • Certificate of incorporation or extract from the commercial register reflecting the change, with Spanish translation, legalised or apostilled.
