Patents - Filing Requirements


Patent Filing Requirements
  • Power of attorney simply signed.
  • Deed of assignment simply signed by the inventor if the applicant is not the inventor.
  • Certified copy of the priority document if claimed, with Serbian translation.
  • Request for the grant of a patent stating the name of the invention, the applicant(s) and inventor(s) names together with their domicile or place of business.
  • Description of the invention with Serbian translation (the technical field to which the invention relates, the defined problem for which solution is required the protection, state of the art which as far as known to the applicant, can be regarded as useful to understand the invention, expostulation of the essence of the invention, short description of the drawings, if any and detailed describe at least one way of carrying out the invention, using examples where appropriate and referring to the drawings, if any).
  • One or more claims defining the subject matter of the invention and fully supported by the description with Serbian translation.
  • Drawings and other materials, where necessary for the understanding of the subject matter of the invention.
  • Short summary of the invention (an abstract) with Serbian translation.

Notes
The power of attorney can be submitted subsequently within 30 days as from the receipt of the official invitation. This term can be extended several times up to 6 months.

The certified copy of priority document can be submitted subsequently within 3 months as from the application date. This term cannot be extended.

Annuity Requirements
  • No documents are required.

Patent Search
  • No documents are required.

Patent Assignment
  • Power of attorney signed by the assignee.
  • Deed of assignment document signed by the assignor and assignee.

Notes
  • Late filing of documents: not allowed.

Patent Merger
  • Power of attorney simply signed.
  • Merger agreement document.

Notes
  • Late filing of documents: not allowed.

Patent Recordal of Change
  • Power of attorney reflecting the new name or address simply signed.
  • Certified copy of the certificate of incorporation or the extract from the commercial register reflecting the change.

Notes
  • Late filing of documents: not allowed.

Patent License
  • Power of attorney signed by the licensee.
  • License agreement document signed by both parties.

Notes
  • Late filing of documents: not allowed.
