Patent Filing Requirements

Patent protection is available by filing a national application or through the registration of a UK granted patent.

Although it is possible to designate Seychelles in a PCT international application, the laws in Seychelles have not been amended to cater for the PCT. Accordingly, it is not clear whether enforceable rights will be obtained via PCT national phase filings.

National filing and PCT filing requirements:
1- Power of attorney, notarised.
2- Specification, claims, formal drawings, and abstract.
3- Certified copy of the priority document if claimed.
4- Copy of International Preliminary Report on Patentability.
5- Deed of assignment document simply signed if the applicant is not the inventor.

Requirements for the re-registration of a granted UK or European (UK) patent:
1- Power of attorney, notarised.
2- Copy of the granted UK or European (UK) patent.

Annuity Requirements
  • No documents are required.

Patent Search
  • No documents are required.

Patent Assignment
  • Power of attorney with company seal, notarised.
  • Deed of assignment document signed by the assignor and assignee, notarised.

Notes
  • Late filing of documents: not allowed.

Patent Merger
  • Power of attorney with company seal, notarised.
  • Merger agreement document, notarised.

Notes
  • Late filing of documents: not allowed.

Patent Recordal of Change
  • Power of attorney reflecting the new name or address, notarised.
  • Certificate of incorporation or extract from the commercial register reflecting the change, notarised.

Notes
  • Late filing of documents: not allowed.

Patent License
  • Power of attorney signed by the licensee, notarised.
  • License agreement document signed by both parties, notarised.
