Trademarks - Filing Requirements


Filing Requirements
  • Power of attorney simply signed.
  • Certified copy of the priority document if claimed, with Spanish translation.

Notes
  • Late filing of documents: 30 days from filing date without penalty.
  • Extension of time for late filing of documents: not allowed.

The priority document with its translation should be filed within three months from the filing date.

Registration with Customs Duty
  • No documents are required.

Notes
This registration is done under the TRIPS Agreement; Article 51 which was ratified by Uruguay through Law No. 16.671 dated December 13, 1994.

Although this registration is not made public, it was recently created, and is considered a formal registration by the National Customs Authority (NCA), where companies inform about their brands and legal representative to said State body.

The NCA is currently going through a reform in terms of its functions, duties and procedures. In this context it created the Intellectual Property Crimes Unit.

For that reason, this Unit is receiving and registering trademarks at the NCA, sealing and signing the corresponding filings.

The Trademark Registration at Customs will allow the State entity and its employees to know the product marks of the different firms and they will proceed to retain the goods showing such trademarks when they do not coincide with the original trademark.

Renewal Requirements
  • Power of attorney simply signed.
  • Photocopy of the registration certificate.

Search Requirements
  • No documents are required.

Assignment Requirements
  • Power of attorney signed by the assignee.
  • Deed of assignment document signed by the assignor and assignee.

Merger Requirements
  • Power of attorney simply signed.
  • Merger agreement document signed by both parties.

Notes
  • Late filing of documents: not allowed.

Recordal of Change
  • Power of attorney reflecting the new name or address simply signed.
  • Certified copy of the certificate of incorporation or the extract from the commercial register reflecting the change.

License Requirements
  • Power of attorney signed by the licensee.
  • License agreement document signed by both parties.
