A design shall be considered new if no identical design has been made available to the public anywhere in the world before the date of filing of the application for the grant of an industrial design for such a design or if no earlier filed application for the grant of an identical industrial design exists.
In the case that priority is claimed, it shall be considered that a design is new if it has not been made available to the public before the day on which priority is granted.
Designs shall be deemed to be identical if they differ only in inessential details.
