Trademarks - Filing Requirements


Filing Requirements
  • Power of attorney legalised by the Argentinean Consulate, or apostilled.
  • Certified copy of the priority document if claimed, with certified Spanish translation.

Notes
  • Late filing of documents: allowed within 40 days from filing date without penalty.

Late filing of the priority document is possible within 90 days from filing date without penalty.

A mid-term sworn declaration of use must be submitted between the 5th and 6th anniversary of the mark´s date of the grant. A penalty fee will occur for the late filing of said declaration per year.

Registration with Customs Duty
  • Power of attorney legalised by the Argentinean Consulate, or apostilled.
  • Proof of registration or copy of a valid registration certificate.

Notes
  • Late filing of documents: not allowed.
  • Extension of time for late filing of documents: not allowed.

Renewal Requirements
  • Power of attorney simply signed.
  • Declaration of use simply signed.

Notes
  • Late filing of documents: not allowed.
  • Extension of time for late filing of documents: not allowed.

Search Requirements
  • No documents are required.

Assignment Requirements
  • Power of attorney legalised by the Argentinean Consulate, or apostilled.
  • Deed of assignment document signed by the assignor and the assignee, legalised with certified Spanish translation.

  • Extension of time for late filing of documents: not allowed.

Merger Requirements
  • Power of attorney legalised by the Argentinean Consulate, or apostilled.
  • Merger agreement document signed by both parties, legalised with certified Spanish translation.

Notes
  • Late filing of documents: allowed within 40 days from filing date without penalty.
  • Extension of time for late filing of documents: not allowed.

Recordal of Change
  • Power of attorney reflecting the change, simply signed.
  • Official proof of the change issued by the relevant authorities, legalised by the Argentinean Consulate with certified Spanish translation.

License Requirements
