Patents - Filing Requirements


Patent Filing Requirements
  • Power of attorney legalised.
  • Certificate of incorporation or extract from the commercial register legalised.
  • Specifications, claims, abstracts, and drawings in English with an Arabic translation.
  • Deed of assignment document if the applicant is not the inventor, legalised.
  • Copy of the priority document, if claimed, legalised.

Notes
  • Late filing of documents: not allowed.

Required Documents for PCT National Phase Applications:

  • Power of attorney legalised.

  • Certificate of incorporation or extract from the commercial register legalised.

  • Specifications, claims, abstracts, and drawings in English with an Arabic translation.

  • PCT preliminary examination report, if available.

  • Deed of assignment document if the applicant is not the inventor, legalised.

  • Certified copy of the priority document if claimed.


Annuity Requirements
  • No documents are required.

Notes
  • Late filing of documents: not allowed.

Patent Assignment
  • Power of attorney legalised by the Libyan Consulate (in case there is no Libyan Consulate, then a legalisation may be made by any other Arabic Consulate).
  • Certificate of incorporation or Extract from the Commercial Register legalised by the Libyan Consulate.
  • Deed of assignment legalised by the Libyan Consulate.

Notes
  • Late filing of documents: not allowed.

Patent Merger
  • Power of attorney legalised by the Libyan Consulate (in case there is no Libyan Consulate, then a legalisation may be made by any other Arabic Consulate).
  • Certificate of incorporation or Extract from the Commercial Register legalised by the Libyan Consulate.
  • Deed of merger legalised by the Libyan Consulate.

Notes
  • Late filing of documents: not allowed.

Patent Recordal of Change
  • Power of attorney legalised by the Libyan Consulate.
  • Certificate of change legalised by the Libyan Consulate.

Notes
  • Late filing of documents: not allowed.

Patent License
  • Power of attorney signed and stamped by the licensee company’s stamp and legalised by the Libyan Consulate in the applicant's home country.
  • License agreement legalised by the Libyan Consulate.
  • Extract of the entry of the applicant's company in the Commercial Register legalised up to the Libyan Consulate.
