Trademarks - Filing Requirements


Filing Requirements
  • Power of attorney legalised.
  • Copy of the certificate of incorporation or extract from the commercial register, legalised.
  • Copy of the business license or professional association if the applicant is a normal person.
  • Certified copy of the priority document if claimed.

Notes
  • Late filing of documents: not allowed.


  • If the applicant is of a local national, then the notarization of the commercial register by the notary public will suffice.

  • The legalisation of the documents must be made in the applicant's country.

  • The entirety of class 33, alcoholic goods in class 32, and products related to the Christmas tree in class 28 are prohibited and cannot be selected for registration.

  • The late filing of the required documents is not possible.

  • Trademark protection is restricted to the trademark as applied for, i.e., Applications consisting of a black-and-white trademark will only protect the black-and-white version of the mark and will not extend to other coloured versions of the brand. The applied-for mark must be identical to the mark in use.


Renewal Requirements
  • Power of attorney legalised.

Search Requirements
  • No documents are required.

Assignment Requirements
  • Power of attorney signed by the assignee, legalised.
  • Deed of assignment document legalised.

Notes
  • Late filing of documents: not allowed.

Merger Requirements
  • Power of attorney legalised by the Libyan Consulate.
  • Certificate of incorporation or Extract from the Commercial Register legalised by the Libyan Consulate.
  • Deed of merger legalised by the Libyan Consulate.

Notes
  • Late filing of documents: not allowed.

Recordal of Change
  • Power of attorney under the new name or address, legalised.
  • Certificate of change of name or address legalised.
  • List of the desired trademarks.

Notes
  • Late filing of documents: not allowed.

License Requirements
  • Power of attorney signed and stamped by the licensee company’s stamp and legalised by the Libyan Consulate in the applicant's home country.
  • License agreement legalised by the Libyan Consulate.
  • Extract of the entry of the applicant's company in the Commercial Register legalised up to the Libyan Consulate.
