Registration with Customs Duty

Notes
The Custom Authorities offer assistance in connection with violation of trademarks related to import of goods. This will also apply for goods that they know are counterfeits. However, one should be aware of the fact that there is no systematic control, but the Customs will act upon notices of possible counterfeits through their reporting system. This means again that they mostly are dependent on reports from the rightful holders of the trademarks.

There is no systematic registration facility with the Customs that automatically protects trademarks. Thus, trademarks are only registered through the Norwegian Industrial Property Office (NIPO).

Renewal Requirements
  • Power of attorney simply signed.

Search Requirements
  • No documents are required.

Assignment Requirements
  • Power of attorney signed by the assignee.
  • Deed of assignment document signed by the assignor and assignee.

Merger Requirements
  • Power of attorney simply signed.
  • Merger agreement document signed by both parties.

Notes
  • Late filing of documents: not allowed.

Recordal of Change
  • Power of attorney reflecting the new name or address simply signed.
  • Certified copy of the certificate of incorporation or the extract from the commercial register reflecting the change.

License Requirements
  • Power of attorney signed by the licensee.
  • License agreement document signed by both parties.
