Patents

According to the Slovenian Industrial Property Act, patents are granted for any inventions, in all fields of technology, which are new, involve an inventive step and are susceptible of industrial application.

The exclusive right to prevent third parties not having the owner’s consent from the acts of making, using, offering for sale, selling, or importing for these purposes the invention. It also confers the right to take legal action against any person exploiting the patented invention without the owner’s consent, and the right to claim damages. It is up to the owner to bring an action under civil law for any such infringement. The Slovenian Intellectual Property Office, however, does not take sides in any dispute.
