MUSCAT – This is to advise that Oman has adopted the new unified Gulf Cooperation Council (GCC) Trademark Law on 31 July 2017 by Royal Decree number 33 of 2017, which was published in the Official Gazette number 1204 on 30 July 2017. The Implementing Regulations by the Trademark Office, however, are expected to be released soon.
Accordingly, provided below are some of the main procedural changes to be introduced:
- The definition of a trademark is extended to include colour, sound and olfactory marks;
- Multi-class applications will become possible;
- It will be possible to claim priority based on an earlier-filed foreign application, and
- Oppositions against published applications must be filed within 60 days from the date of publication where previously it was 90 days.
