Aman Real Estate Development Management Company, a Jordanian company, has filed a trademark application in class 36 under number 121535.
The above application was accepted and published in the Official Gazette on 20 June 2014 subject to the opposition period of 3 months.
Acting on behalf of our client, Amanresorts Limited, a Singapore company, we filed an opposition against said application based on the following:
- The plaintiff owns prior registrations for “Aman” and “Amanresorts” in the home country and abroad;
- The confusing similarity between our client’s trademarks and the defendant’s mark;
- Our client’s trademark is a well-known mark, as it has been used world-wide since 1988, and
- The infringing part of the opposed mark is the word Aman which constitutes the main element of our client’s mark.
Considering our above arguments, the Registrar issued its decision and cancelled the subject application. Said decision became final since it was not appealed before the court within 20 days.
