Egypt – Conflict Between BM and BMJ

Our client, EDNOLITCHNO DRUJESTVO S OGRANITCHENA OTGOVORNOST “FINANSKONSULT”, is the original owner of the trademark BM with International Registration (IR) No. 1133949.

It came to our client’s attention that an application for BMJ was filed in Egypt under Filling No. 284601 on the 29 January 2013 in class 34 and was published in the Official Gazette No. 882 on 7 February 2014.

Acting on behalf of our client, we filed an opposition against the application; our opposition was based on the following:

1. Similarity between our client’s mark and the opposed mark in terms of pronunciation and general appearance;
2. Prior registration of our client’s mark BM in Egypt IR No. 1133949, and
3. Prior use of BM by our client since 2012.

Considering the above arguments, the Registrar issued its decision in our favour by accepting our arguments and cancelling the subject application based on the prior registration of our client’s mark BM.
