Regulation (EU) No 2015/2424 of the European Parliament and the Council amending the Community trade mark regulation has been published in the Official Journal of the European Union. The Amending Regulation will enter into force on 23 March 2016.
The use of general terms, including the general indications of the class headings of the Nice Classification, shall be interpreted as including all of the goods and services clearly covered by the literal meaning of the indication or term. This means that protection will be applied only to the items listed in the application.
Proprietors of EU trade marks applied for before 22 June 2012 which are registered with respect to the entire heading of a Nice class, may declare that their intention on the date of filing had been to seek protection with respect to goods and/or services beyond those covered by the literal meaning of the heading of that class. A grace period of six (6) months will be granted to do so from 23 March 2016 to 23 September 2016.
