On 27 October 2004, our client, Limabond Ltd, a Syrian company, filed a trademark application for ” Mario Zignoti” – words in Arabic and Latin and head device – in Class 25 in respect of the goods ready-made clothes, men’s shirts, and women’s blouses.
The application was accepted and proceeded to publication; it was advertised on 1 August 2005 and open for 3 months for opposition purposes.
Lanificio Ermenegildo Zegna S.P.A. filed an opposition before the Registrar against the said application based on confusing similarity with their ERMENGILDO ZEGNA trademark which was registered in Oman since 1992. They claimed that the applicant filed his trademark in bad faith to benefit from the international reputation of ERMENGILDO ZEGNA, Limabond Ltd has used this Italian name even though its nationality is Syrian, and thus the registration of Mario Zegnoti will confuse the public regarding its origin and will lead to unfair competition.
