KHARTOUM – The Sudanese Registrar General of Intellectual Property Administration (TMO) has begun enforcing the provisions of Article 19(3) of the Trade Marks Act, 1969 concerning late trademark renewals.
Under the law, trademark owners are granted a six-month grace period following the expiry of a registration, during which renewal may still be effected upon payment of the prescribed late renewal penalty fee.
In practice, however, the TMO had for many years adopted a more flexible approach, allowing trademarks to be renewed within the grace period without payment of the penalty fee. In certain cases, renewals had even been accepted beyond the six-month period without the imposition of additional charges.
Following the recent resumption of operations and the gradual restoration of normal procedures after the disruptions caused by the conflict, the TMO has ceased applying this practice and has reverted to the strict implementation of the law.
As a result, trademark owners seeking to renew registrations after their expiry date are now required to pay the prescribed late renewal fee in accordance with Article 19(3) of the Trade Marks Act.
