The general department for Intellectual Property Protection in Yemen has lately issued its decision in the opposition filed by the well-known American Company Caterpillar Inc. against a local Yemeni company named Qasem Thabet Saleh AL-Esaaey.
Earlier the said Yemeni Company filed an application for registering the trademark CAT & Design No. 34564 in class 6 which was accepted and later published in the commerce magazine No. 9, 2007.
The verdict was based on the fact that the trademark application filed by the local Yemeni company is a blatant copying of the famous trademark which has been used for a long period of time and worldwide registered. Further, the general department instituted its decision that the opposed trademark application by the Yemeni Company is an attempt to benefit from the notoriety of trademark CAT logo and an act of unfair competition.
